NEW Housing Consumer Protection Act

The Housing Consumer Protection Bill was assented to by the President on 20 December 2024 and published in the Government Gazette on 29 January 2025. The Bill is therefore now an Act and will commence once proclaimed by the Minster of Human Settlements.

 

The New Act has numerous far reaching implications for the sector and we we have summarised some of these for your information. The most significant change is the inclusions of alterations and additions under the act.

Summary of key changes...

 

We don't know exactly when the Minister will proclaim the commencement date of the act however once the act commences“a homebuilder that undertakes repairs, alterations and additions to a home where the construction thereof commences after the commencement date of this Act, must be registered as a homebuilder.”

 

This is therefore a warning to members who are not registered with the NHBRC to consider registering if they wish to conduct business in this sector.
