The National Home Builders Registration Council (NHBRC) remains committed to its mandate of regulating the homebuilding industry and protecting housing consumers. In pursuit of this responsibility, we continuously evaluate and enhance our regulatory instruments to ensure that homebuilding standards align with best practices and evolving industry needs.
The NHBRC has undertaken to remind our stakeholders of compliance with all Housing Consumer Protection Measures Act 95 of 1998 (HCPMA). This forms part of a broader strategy to strengthen consumer protection and promoting a culture of compliance, quality and accountability within the homebuilding sector.
In this regard, the 20/80 enrolment applications and the use of the Annexure 12 Sectional Title Phased Payment (ST001) are clarified as follows:
Furthermore, all valid Financial Guarantees (FGs) must be actively monitored, and claims lodged before their expiry. The NHBRC provincial teams track all FGs to prevent lapses that could adversely impact the enrolment process.
These updates will take effect from 1 January 2026 to allow stakeholders time to plan accordingly. All home builders and relevant stakeholders are expected to fully comply from this date onwards.
