Public Procurement Regulations

Government has given notice that the draft General Public Procurement Regulations, 2026, to be made in terms of section 63(1) of the Public Procurement Act, 2024 (Act 28 of 2024 - ‘the Act’), published for public comment.

 

The Notice was published on 16 April 2026 and provides 60 days for comment.

The draft General Public Procurement Regulations provide —


(a)  a procurement framework within which procuring institutions may develop and implement their
procurement systems, which includes the promotion of strategic procurement, procurement methods,
requirements and procedures, and criteria and weighting for the evaluation of bids;


(b) for a bid committee system and bid validity periods;


(c) for security vetting of bidders;


(d) for contract management;


(e) for the use of other organs of state for purposes of acquiring goods, services and infrastructure;


constructing, repairing or maintaining infrastructure or capital assets; and letting, transferring or disposing
of assets;


(f) specifically for the procurement of infrastructure and capital assets, travel and accommodation, legal
services and leases;


(g) for threshold and conditions for preferential procurement through set-asides, pre-qualification and
subcontracting as a condition of bid;


(h) appropriate steps for interventions by the Public Procurement Office and provincial treasuries;


(i) competency requirements for officials involved in procurement;


(j) declarations of interest, codes of conduct for officials, accounting officers, accounting authorities and
members of bid committees;


(k) debarment periods and a debarment register;


(l) for the use and management of Information and Communication Technology systems, access to
information and the retention of information; and


(m) for transitional measures.
